Immigration-law.com just reported that "As reported by the USCIS, the Service Centers are currently experiencing the receipting frontlogs. In some cases, there are frontlog of 45 days or longer...".
I pray to God that I will not need to wait 2 months for my receipt...

Your case is like me, except I am porting Priority date from my previous approved I-140 Eb3 case. Your new I-140 transferred to Texas Service centre because your employer comes under Texas Service centre. Your residency location also comes under Texas service centre. So you will receive I-485, I-765 and I-131 with SRC numbers. But it may take longer time.
Good thing is Texas Service center is processing I-140 applications in May 2007. Max they are taking 5 months. People are discussing about LUD, it doesn't matter. It seems Texas service centre doing some regular maintenance. If you register your old approved H1s, their LUDs also changing.

Thanks for the info... and sounds good to see that the I-140 takes less time in this center... I hope I will get something soon...Do you know if I can get Finger Prints notices or my EAD without the Receit Notices??? or I need to have that first before start getting something else??? :confused:

I think one need to create database based on who came in what year and what is the priority data's . True there are people like me came in 2000 and still has priority date as Dec 2004, this is not my fault, this is forced by GC process tied with employer.
The landing or start date of H1b/L1B + old priority date should be the real beneficiary of spillover in respective of EB.

Question remains.. Why ? Why people dont do what is expected when they know that these initiatives are going to help them?
Lack of convincing power that IV will do something. Lack of trust in IV organization. Lack of advertisements. lack of communication.
How do successful organizations ask people to donate money? There is something to be learned. If the cause is right (we all know it is) then its a matter of delivering this message that will get people convinced. Lot of charities get donations. How? I think that is what we need to learn. Guyz, i met attorney. got copy of non compete agreement from a co-worker. I feel kind of releived after what he said.
As per him, every non-compete agreement that is signed cannot be neccessarily enforced in the court of law. If the sole purpose is to avoid ordinary competition, it is unreasonable and unenforceable. If the agreement is ever challenged in court, the most important question, which will be posed from the Judge to the employer, is "What is the legitimate business purpose that is served by this non-compete agreement?"
Now as h1b employees, as every one knows we r not the key personnel in the company. we do not carry with us any trade secrets or confidential information which might harm their business.
AS per him the higher up the "food chain" an employee is at a company, the more willing courts are to enforce non-compete agreements. Upper level employees are typically exposed to more confidential, trade secret, strategic and other information that gives a company a competitive advantage in the market place. The lower down the food chain an employee is, the less likely a court is to enforce non-compete and non-solicitation terms.
Also non competes always have to give some profits to the employee, say a paid vacation, bonus or somethign like that. An employer cannot
just make the employee sign it to restrict him from making better living and not give anything in return....
Seems like these things are favourable to all the h1b employees.

If the worst was to happen how do the USCIS know your wife is now on her own? If you have an H1B visa that has some years to run on it then this would buy time to get I485 approval.
Once the approval comes through what is to stop the USCIS issuing one to you as well as your wife.
If nobody tells the USCIS then the wheels will continue to grind along anyway.

I have been calling USCIS for the last 5 weeks.Today they gaveme my receipt number only for I-765 and not for others.These were porcessed on Sep18.i have not had the receipt in hand.
My checks are also not cashed at this time .Is some one in the same sitiuation as I am.

Mr. Vayalar Ravi , Minister of Overseas Indian Affairs,is coming to USA on June 27,2006. He is coming to Washington DC on July 4 to meet Indian Ambassador and Indian community. We should try to meet him personally and explain the problems we are facing. He can talk to US counterparts and do something for us.
Let us organize an event to meet him on July 4. Since It is a holiday, lot of people can meet him and chat with him.
Like he will care about us. If he does care, he can not do anything unless he gets OK from Madam Sonia:-)

Setting up company is just the first step for Self-Employment. The key things is to demonstrate that new job is in same/similar classification and company has offered "bonafide" job, not just job on paper.
BTW, it is not necessary to have LLC. The corporate structure could be S-Corp or C-Corp also.

In current H1B denial rate becuse of client letters RFE, the self employed AC21 cases shold be more prepared, in case of RFE.

Just forget about GC and save as much as you can to take back home. Treat US the same way Indians treat ME.

Good luck!. In my opinion, you need to know following people very well apart from money if you want to lead the same lifestyle.
1. MLA or MP (Even to get good school admission you need recommendation)
2. DSP or SP level police officer (to have security in life)
3. Thasildar level officer (to have your property secure)
4. Local Dhadha's support (to protect from land acquisition, other dadhas)
5. Good neighbors, teachers and relatives (to protect our loved ones spouse/kids from emotional attack)
And of course at least 2 crores cash (half million US $??). I don't have anything right now, so I would love to spend my rest of live here hoping to get GC some day in my life.

If you happen to be in a police case (auto accident, robbery etc), you'll know how important it is to have links with the police and local politicians, otherwise someone will screw you and you won't be able to do anything.

Don't like EB-3 dates...but looking at EB-2 dates, does this mean that from now on we will see only forward movement in EB-2 I/C dates?
If the first month of the new year didn't retrogress, would every month see a movement of week or two? Or keeping in great USCIS tradition, this is just another 'fluke'? ;)
Ya I presume your assumption is right regarding EB-2 forward movement. But on a whole the EB-2 India/China dates havent forwarded up to my predictions. But we could expect a steady and consistent movement of EB-2 India/China ahead.

What happened to EB3-I, call to action ? I sent out the letters ,but what is the follow-up ? Looks like everyone is interested only in EB2 India and nobody is doing anything about EB3-India.
